Nike Settles Lawsuit Against Kool Kiy

Update August 25, 2023: The trademark infringement lawsuit between Nike and independent design company Kool Kiy has come to an end with a confidential settlement in the favour of Nike. The model in question was the Air Kiy '85, and despite the settlement in Nike's favour, Kool Kiy have announced a collaborative Air Ky '85 that drops today.

The two entities in question are Kool Kiy and Omi, who have been listed as co-defendants alongside China-based footwear manufacturer Xiamen Wandering Planet Import and Export Co., Ltd., better known as Wandering Planet.
"Slam Dunk" or "Cigar" directly from Omi, there are multiple visual examples of Nike pointing out the similarities between the Swoosh-clad product and Kiy and Omi’s versions, which both use a lightning-bolt motif.
Nike are accusing these smaller brands of ‘promoting, copying, and selling’ these trademarked designs as their own. The Swoosh have pointed their finger at Wandering Planet for enabling the manufacture of these products.
Omi founder Omar Carrasquillo has publicly commented on the lawsuit via an all-caps Instagram post. Kiy co-founder David Weeks also took to Instagram to share his thoughts on the situation, albeit with a more cryptic message, ‘Get Ready For the Paradigm Shift’.
